Momo Live Fruit Coin Top-Up Service Agreement

【Read Carefully】 Welcome to using the Momo Live Fruit Coin top-up service! Before agreeing to this agreement, please read carefully and fully understand and comprehend all the rules and requirements of the Momo Live platform, as well as national laws and regulations regarding this type of internet information service, etc. If you object to any clause of this agreement, you may choose not to use the service; using the service implies that you agree to abide by all the provisions under this agreement, as well as any future modifications we make to the top-up service. This agreement uses bold text to highlight clauses that have or may have a significant impact on your rights and interests, and clauses that have or may have the effect of exempting or limiting the liability of the Momo Live platform. Please take note.

【Special Notice】 Users making top-ups must confirm that they have full civil capacity, are at least 18 years old, or are at least 16 years old and rely on their own labor income as their main source of livelihood. Minor users using the Momo Live Fruit Coin top-up service must obtain the consent of their parents or other legal guardians. Momo Live is not responsible for the actions of minor users during their use of this service, nor for any consequences arising from their use of this service.
Momo Live hereby reminds parents to reasonably guide their minor children's online and consumption behavior.

1. Service Description

1.1 Fruit Coin is the virtual currency provided by Momo Live for users to make related consumption on the Momo Live platform. You can freely exchange "Fruit Coin" for various products or services such as virtual gifts. Fruit Coin cannot be exchanged for Renminbi. Please purchase the corresponding amount of Fruit Coin according to your actual needs.

1.2 Fruit Coin belongs to the category of online-delivered top-up virtual goods. Due to its special nature, it is not subject to the constraints of clauses such as the right of withdrawal and the seven-day no-reason return policy for online purchased goods under the Consumer Rights Protection Law. Once a user's top-up is successful, the top-up is considered completed. Momo Live does not provide any refund or reverse exchange service. If there is a dispute arising from the inability to use Fruit Coin, the user can inquire and seek resolution through the customer service hotline.

1.3 Momo Live's top-up system provides different top-up methods such as Google and Apple. Users using this platform for top-up can increase the quantity of virtual currency owned by their Momo Live user account.

1.4 After using the aforementioned top-up methods, users should retain the top-up order number or top-up card as proof for future verification in case of issues. If a user lodges a complaint regarding the top-up service but does not provide any valid proof, Momo Live will not make any compensation or indemnity.

2. Usage Rules

2.1 The user must be the account opener/holder of the bound payment account, able to use the account legally and effectively without infringing upon any third-party rights. Otherwise, if losses are caused to the actual owner of the payment account, the user shall be solely responsible for resolving the resulting disputes and bear all legal liabilities.

2.2 Users must use the top-up methods designated by Momo Live to increase the Fruit Coin quantity in their account. If non-Momo Live designated top-up systems are used for top-up, or if illegal methods are used for top-up resulting in damage to user rights and interests, the user may not demand any compensation or indemnity from Momo Live. Momo Live also reserves the right to terminate the account's eligibility and the right to use various top-up services at any time.

2.3 When using the Fruit Coin top-up system, users must carefully confirm their account and top-up amount. Users shall bear responsibility for damages to their own rights and interests caused by inputting the wrong account, improper operation, or misunderstanding the top-up billing method, leading to scenarios such as topping up the wrong account, selecting the wrong top-up type, or filling in the wrong top-up amount.

2.4 If Momo Live freezes an account and terminates its usage eligibility due to the user's violation of the Momo Live User Agreement or this Top-Up Service Agreement, the user may not demand any compensation or indemnity from Momo Live.

2.5 If the Momo Live platform discovers processing errors due to system failures or any other reasons, whether advantageous to the Momo Live platform or to you, the Momo Live platform has the right to correct such errors after notifying you via email, phone, private message, or other reasonable means. If this measure results in you actually receiving fewer Fruit Coins than you should have obtained, Momo Live will replenish the difference to your account as soon as possible after confirming the processing error. If the error results in you actually receiving more Fruit Coins than you should have obtained, regardless of the nature and cause of the error, Momo Live has the right to directly deduct the difference from your account.

2.6 Users shall not use Fruit Coin top-up for any illegal or criminal activities. Otherwise, Momo Live has the right to terminate the service. In serious cases, the matter will be transferred to judicial authorities according to law.

3. Channel Service Fees

Channel providers corresponding to each top-up method may set related top-up channel service fees according to their standards (which may be indicated on the top-up operation page or other pages of the channel provider) and charge users during top-up. Momo Live hereby reminds users: Please pay attention to the channel service fees for each top-up method and choose the top-up method according to your own needs.

4. Disclaimer

4.1 You may view your account's Fruit Coin balance on the web page or mobile APP at any time. If you have any objection to this record, you should immediately raise it with the Momo Live platform. If the Momo Live platform confirms an error after verification, it will be corrected; otherwise, you agree that the transaction records on the Momo Live platform serve as the sole valid evidence for Fruit Coin transactions.

4.2 Momo Live platform has the right to set matters related to transactions from time to time based on considerations such as transaction security, including but not limited to transaction limits, transaction frequency, etc. You understand that the aforementioned settings by the Momo Live platform may cause some inconvenience to your top-up transactions, and you have no objection to this.

4.3 Under any circumstances, liability for services related to your purchase of Fruit Coins provided by third parties shall be borne by such third parties. The Momo Live platform does not assume such liability.

4.4 Any losses or liabilities arising from your own reasons causing the Momo Live platform to be unable to provide the Fruit Coin purchase service or causing any errors during the provision of the Fruit Coin purchase service shall be borne by you. Momo Live platform assumes no responsibility, including but not limited to:

  • (1) Your failure to operate according to this agreement or any rules published by the Momo Live platform from time to time;
  • (2) Losses due to the invalidation, loss, or suspension of your Momo Live account;
  • (3) Losses or liabilities caused by reasons related to your bound third-party payment institution account, including your use of an uncertified third-party payment account or a third-party payment account not belonging to you, or the freezing or seizure of your third-party payment account;
  • (4) Property losses caused by you disclosing your password to others;
  • (5) Property losses caused by your personal intentional acts or gross negligence.

4.5 The Momo Live platform system shall not be liable for damages when it cannot operate normally due to the following circumstances, preventing you from using various services or causing any loss of virtual property. These circumstances include but are not limited to:

  • (1) During system downtime maintenance, upgrades, or adjustments announced by the Momo Live platform;
  • (2) Failure of telecommunications transmission or equipment preventing data transmission;
  • (3) Force majeure factors such as typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, government controls, etc., causing obstacles in the Momo Live platform system preventing the execution of business;
  • (4) Service interruption or delay caused by reasons such as hacker attacks, technical adjustments or failures by telecommunications departments, website upgrades, or issues with relevant third parties.

5. Service Change, Interruption, or Termination

5.1 The Momo Live platform may change the service or update the terms of this agreement at any time according to business needs but shall promptly indicate the modifications on relevant pages. The modified service agreement shall replace the original service agreement once published on the page. You may consult the latest top-up service agreement on the Fruit Coin top-up page at any time.

5.2 If any of the following situations occur, the Momo Live platform has the right to interrupt or terminate the provision of network services under this agreement to you at any time without notifying you:

  • (1) The personal information you provided is untrue;
  • (2) You violate the purchase rules stipulated in this agreement;
  • (3) You violate the Momo Live User Agreement and its Momo Live live streaming platform management rules.

In addition to the aforementioned situations, the Momo Live platform also reserves the right to interrupt or terminate part or all of the network top-up services at any time without prior notice to users. For any losses caused by the interruption or termination of top-up services, the Momo Live platform shall not be liable to users or any third party.

5.3 If a user violates the rules by using a non-personal Apple App Store account for top-up on behalf of others, or illegally purchases Fruit Coins through other channels not recognized by the Momo Live platform, then Momo Live has the right to freeze the account and impose corresponding penalties. Serious violations will result in account suspension.

5.4 When using the Momo Live platform, if a user violates national laws and regulations, the User Registration Agreement, the provisions of this agreement, or other Momo Live platform management regulations for users, Momo Live has the right to temporarily or permanently suspend your account. From the time of account suspension until its lifting (if applicable), the remaining Fruit Coins in your account will be temporarily frozen or fully deducted, cannot be used to purchase virtual products or services on the platform, and the cash value paid for the Fruit Coins will not be refunded.

6. Governing Law, Jurisdiction, and Others

6.2 The formation, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of Mainland China.

6.3 If any dispute or controversy arises between you and Momo Live due to this agreement, it shall first be resolved through friendly negotiation; if negotiation fails, you agree to submit the dispute or controversy to the competent people's court located at Momo Live's place of jurisdiction.

6.4 If any provision of this agreement is deemed abolished, invalid, or unenforceable, that provision shall be considered severable and shall not affect the validity and enforceability of the remaining provisions of this agreement.
